Terms and Conditions For Employers recruiting Temporary Workers

1. General

1.1.              In these terms and conditions “the temporary worker” shall mean the candidate supplied by Pick n Mix Recruitment to the client. The “client” means the employer (including any officer, employee or agent thereof) to whom Pick n Mix Recruitment introduces the candidate.

1.2.              These terms and conditions are deemed accepted by the client by virtue of their engagement of the candidate and any business undertaken by Pick n Mix Recruitment in relation to any candidate is transacted subject to these terms and conditions, which shall apply to the exclusion of any others. No variations to these terms and conditions shall be binding unless approved in writing by Pick n Mix Recruitment. These terms and conditions and all agreements with clients shall be governed by English Law and the client agrees to submit to the exclusive jurisdiction of the courts of England and Wales.

2. Fees

2.1.         An hourly rate for all hours actually worked by the temporary worker is payable by the client. Hours shall be calculated to the nearest quarter of an hour. Travel or any other expenses, should the client agree to pay them, will be itemised on the invoice. No charge is made for lunch hours and charges exclude National Health, Social Security and Statutory costs.

2.2.         The signature by the client agreeing the hours worked by the temporary worker shall be conclusive evidence that the client is satisfied with the work carried out by the temporary worker and will pay the charges in full and without dispute or deduction.

2.3.         The invoice should be paid within 14 days of receipt. If the client fails to pay as per the conditions stated, Pick n Mix Recruitment shall be entitled to charge the client interest calculated at 2% above the prevailing base rate of the Bank of England compounded on the total sum of the invoice, to which VAT shall be added.

2.4.              Invoices for temporary workers will be issued weekly to enable prompt payment within 14 days of the invoice date. All payments should be made to LL Services Ltd, Research House, Fraser Road, Perivale, Greenford, Middlesex, UB6 7AQ.

2.5.              Should the client take on a temporary worker introduced to them by Pick n Mix Recruitment for a permanent position, they will be liable for a full percentage of applicant’s annual salary. If the applicant has been working for 13 weeks (inclusive) then the temporary to permanent fee is waived.

2.6.              Introduction from the agency is confidential. Should the client or any member of the client’s staff recommend the introduction of the applicant to any other firm, corporation or any other person, resulting in an engagement, then the client will be liable for the full permanent placement fee (see Terms & Conditions for Employers – Permanent). Should the employer or other party a mentioned above employ the candidate within a six-month period, they shall be liable for the full permanent placement fee.

2.7.              Should changes be made to these terms and conditions, new rates may apply and will be confirmed in writing.

3. Liability

3.1.         Applicants are carefully pre-selected to meet the client’s requirements and Pick n Mix Recruitment are not liable after the applicant has been engaged with the company (for either temporary or permanent work) for any resulting loss or damage to company property, loss of profits, injury or accident to persons, fraudulence or dishonesty.

3.2.              The temporary worker is supplied on a contract basis from Pick n Mix Recruitment. Pick n Mix Recruitment is the employer of the temporary worker and is responsible for paying tax and national insurance on his/her behalf.

3.3.              Temporary workers are given detailed instructions on the standard of work and behaviour expected from them whilst on assignment through Pick n Mix Recruitment, however the supervision and control of a temporary worker for the duration of the temporary assignment is the client’s responsibility.

3.4.              The temporary worker should be covered by the client’s insurance whilst under their control and the client takes full responsibility for the temporary’s assignment.

3.5.              Should the temporary worker prove unsatisfactory, he/she should leave the assignment immediately. Pick n Mix Recruitment should be informed and there will be no charge if this applies within the temporary worker’s first day of work.
